Boy for all the braggin you Texans do, you sure have some jack off cops. 
Why is Gov Perry putting up with that?
First the roadside cavity search, then the mass dna swabs - both violations of the 4th; now arresting a guy for legally carrying a rifle.
I would also object to an officer confiscating my weapon, as well as arresting and hand cuffing me, without any legal reason.
Even if he wins, he is out of thousands of dollars - all because of an over bearing moron cop.

An Army soldier convicted in November of a misdemeanor count of interfering with the duties of a police officer for carrying an assault rifle while hiking with his teenage son plans to appeal the decision.
Grisham was carrying an AR-15 rifle and a concealed handgun, for which he had a permit. Texas law allows for rifles to be carried in public.
Someone reportedly called police expressing alarm over a man carrying a rifle along a road. Officer Steve Ermis responded and, according to court testimony, was initially concerned because he didn't know Grisham's intentions.
Rannefeld argued at trial that Grisham was carrying the rifle to protect against aggressive wild hogs. He reportedly said Ermis "went above and beyond to control and intimidate," when he stopped the two.
Court documents say Grisham tried to prevent Ermis from taking his rifle and later resisted as the officer attempted to place Grisham's hands behind his back. Prosecutor John Gantt Jr. told jurors that Grisham refused to follow Ermis' orders.
Grisham's son used his cellphone to record the confrontation.

I'm torn on those situations after all of the youtube vids I've watched of people "exercising" their rights to open carry. In the vast majority of them its blatantly obvious that they are trying to goad the police into a confrontation. They are literally out looking for trouble and trying to cause a scene, video tape it, and put it on the internet, not just carrying for safety, security, protection from wild hogs, etc.
Go to youtube and search open carry, you'll see what I mean.
Sure, they have the right to do it, but there is a time and a place and it should be done for the right reason.
