Hmm....funny that someone that probably doesn't know a thing about commercial law is going to cast stones. Retarded? Maybe you should look in the mirror. And maybe before you begin making your community college accusations, you should take a little time in community college yourself before arguing with people who have actually taken UCC classes and contracts classes in law school, and then have gone on to pass multiple bar exams on which commercial and business law were tested, and then gone on to practice business law professionally. Listen, I don't like to hurl insults, but before you begin speaking as an "authority" on something and demeaning other people who have differing opinions, you should stop and think for a moment that perhaps there really are people out there that quite possibly know more than you about certain subjects.
OH COME ON. First, I did go to community college...and then on to a Univeristy...and am now in Business School. You don't have to list your creditials for me to take you seriously. Who and what I take seriously, I base on intelligence. Not pieces of paper on the wall. Someone could have 50 degrees, and I would still NOT respect or take them seriously; for no more reason than he is an idiot.

Secondly, I never said I was an authority....I am speaking merely from COMMON SENSE. a class action law suit? grow up.

In a world of people blaming others and trying to "work the system", I am sure you could win. But ethically, this isn't legit.

Thats from the order guide. It was part of the active anti theft, not a stand alone option. If it was seperate, and you ordered ti and they stopped makign it, then that would be different.

Now just imagine ford held up all production of cars with active anti-theft to fix a problem. Evidently it was nothign simple, because otherwise i'm sure it would have been fixed. Granted I have it on ym car, but honestly, the range on it is not good and I am always right near ym car before the windows roll down. Plus I am always concerned that I will coem out oneday to find my windows down by themselves.
Exactly my point. I sell computer parts. I can order 10 cases in that I expect all to be the same but every now and then 1 arrives looking a little different. The manufacturer changed the design to compensate for a flaw in the design. These things happen all the time.

Original brochure also shows BFGoodrich Gforce KDW tires on the GT and in the Canadian brochure even has them listed as the tire you get when you purchase upgrade rims. I purchased the upgraded rims but got Pirelli tires. Why, because FORD changed their minds and went with Pirellis. The brochure states that basically everything listed is subject to change without notification. So am I going to complain to FORD and try to sue them, no. Am I mad that I didn't get what I thought I was going to get, darn right I am. However, one thing with brochures is you gotta read the fine print. Just because the brochure says it is there doesn't mean it is. Heck, I went on a cruise that showed a pretty cool casino on it in the brochure. Well it was nothing like that at all. When I asked about it they said "we have yet to build a ship like that. The brochure only gives you an indication of what we have to offer. We do have a casino, but not like the one in the brochure."
couldn't have said it better. sounds like alot of people in this thread need to step out in to the real world.

ladies....please....calm down your all acting like they do over on the tuner forums.... Surfn if it was a waste of time to read it then why waste more time arguing over it.....moc1976 if it is worth it to you to spend a lot of time and effort in a law suit to get an oil change then go ahead (word of advise if that will make you happy mention that when you file the suit, I am sure Ford would love to give you an oil change to stop a lawsuit), but I dont think it is worth it, I still havent really figured out what the whole point of rolling down the window from outside, if I am about to get in its not enough time to cool the car and its actually easy to get in and flick the switch on the door than it is too hold the button down on the fob, and if its because I will be near my car from the moment I get out I wouldnt have rolled it up to begin with, now it would be nice if it rolled up but you have to put your key in the door to do that so whats the point, barely saving any time there. And personally if they had to stop making the IUP because of safety issues with the airbags I would be all for it, it would stink but hey its a safety issue, not really the same thing here. but I dont think this is anything that would be worth the time and money to sue over, ford would just stretch it out as long as possible until you either gave up or ran out of money, that is until it got to the predetermined point in time and money that they would already have calculated out that it would be just cheaper to pay you off instead of continuing from there and it would do them no harm, but thats just my .02.

Well, that is your choice isn't it? I honestly don't remember the brochure saying anything about the tires other than the size. I saw no mention of brand, so I'm not sure your comparo holds water. Which is different than saying that the active anti-theft includes global open/close, and then turning it off. It's like I said, it doesn't keep me up at night, but if there was a class-action, I would take part in it! And if you were to decide to do something about the tire issue, I would say to have at it!

Now if we all ordered the mustang and got a chevy, I think we would have a case.

I have a 9 year old daughter that most would consider "retarded", I'm not sure how she fits into all of this.

true...or they would want to sweep it under the rug, to get rid of bad press. I think that is what some scavengers who file class action suits think. It's sad.

she is mentally disabled? I don't think anyone here was talking about your daughter Mike. Any form/slang of the word "stupid" can be applied to a medical condition (idiot, dumb, etc.).

grow up.
Your problem is that you clearly do not respect anyone's opinion on here that differs from yours. Otherwise you would not call it "retarded" and tell people to go to community college. Also, did you ever think that being in business school, perhaps your views may be a little biased towards business rather than the consumer? I only list my credentials because obviously you have no respect for others' opinions, and I thought if I showed I may have a clue what I am talking about, you might come off the high horse. Clearly I was wrong. You are the master of all knowledge, and no one may refute you on anything, no matter their education or experience.

Blaming others? If you buy something you don't get in full, who else are you to blame? The consumer for buying it? The distributor? Maybe the old lady on the street corner? No. You blame the manufacturer of a product that does not deliver the agreed-upon product. It is not really that difficult to comprehend. Disclaimers or not, the Uniform Commercial Code has a lot of safeguards, including a number of provisions invalidating disclaimers. So it is quite possible that even if Ford states they can change options at anytime, they cannot so long as a purchase order has been signed at the time the features were available or set forth as being available, without compensating the purchaser.

I don't understand why everyone is rising in defense of Ford. If another individual on the street sold you something and misrepresented what you were getting, you would want restitution, and indeed would be deserving of restitution, after you found out you didn't get what you paid for. This is the same principle on a larger scale. Ford represented, and still does by virtue of the fact that it remains in their own owner's manuals, that this was a feature of the option. It was not. It is only fair that Ford makes it right, by either installing a working version of the feature or by compensating those who purchased an option of which they did not get full value.

I personally think it sad that we have come to the point that we need companies to put dislcaimers on everything like

"Ford Divison reserves the right to change product specifications at any time without incurring obligations"

to protect themselves.....grow up, its like little kids running to mommie because little billy wont let them play with his legos anymore. You dont need that feature, yeah they told you it would be an option, but as adults they had a problem couldnt resolve it and so they eliminated it instead of having a bunch of people complaining that their car doesnt work right all of the time, so you cant have your button to roll down your windows, boohoo, big bad ford told you you could have it and then changed their minds, life isnt fair, man how did you guys ever make it though life without your mommies to fight your battles for you? if you dont like it sell the car...someone will want it, or if you havent bought one yet then dont get one...or heres a novel idea, go get an aftermarket system that will do that and probably better.

I wanted the hood, scoops, HP, 6 speed transmission, wheels, glassback roof and everything else that was really cool on the concept but I didnt get them. I still bought the car and I am not planning on sueing ford because they said the car would have all of that.

My God, this logical disconnect that is so prevalent in these posts is amazing.

"You were told you would get something you paid for, you didn't get it, therefore you are whining because you actually want what you paid for?" That's real coherent, guys.

So, we should just now not hold companies accountable for this kind of thing? Where then do we draw the line in allowing companies to make the decision of the product you actually receive in comparison with the product you ordered?

I can tell you now, it will always flow against the consumer. If we do not enforce the obligations of manufacturers to their consumers, they will always choose to take our money and deliver a more inexpensive product.

I tried to work with Ford on compensation, I called their help center a number of times and all they would say is talk to your dealer. THe dealer would say there's nothing they can do, so why can't Ford man-up and do something about it. Especially for the people calling in about it????

did you really buy the car because of that feature I think the arguement against the suit is simply taking the high road here....its not worth it, its not that big of a deal, the car is still frickin great, I realize some of you didnt get this option, but is it REALLY worth it....if so then I appologize go right ahead and sue its your right....but come on, lets be real its really not that big of a deal so grow up and stop whining about it, I think we are just saying that it is a bit excessive.

If this thread is so "retarded" as you call it, and a waste of your time, why are you still posting here? If you don't have anything to offer other than calling people names, you don't really need to say anything.

Your problem is that you clearly do not respect anyone's opinion on here that differs from yours. Otherwise you would not call it "retarded" and tell people to go to community college (I never told people to go to Community College...what are you talking about?). Also, did you ever think that being in business school, perhaps your views may be a little biased towards business rather than the consumer? (Nope, not at all...I am very fair and balanced...just like FOX news.) I only list my credentials because obviously you have no respect for others' opinions, and I thought if I showed I may have a clue what I am talking about, you might come off the high horse (ah...I do respect other's opinions...just as they are on their high horse of bashing Ford, I am arguing the otherside (you said you went to lawschool right??). Clearly I was wrong. You are the master of all knowledge, and no one may refute you on anything, no matter their education or experience. (thanks, I like "Master" as a title. lol. wow...I never argued specifics of a court case or filing a suit, I simply argued/stated an opinion of the idea. I never once said it couldn't be done, where knowledge of civil law would come in to play)

Blaming others? If you buy something you don't get in full, who else are you to blame? The consumer for buying it? The distributor? Maybe the old lady on the street corner? No. You blame the manufacturer of a product that does not deliver the agreed-upon product. It is not really that difficult to comprehend. So it is quite possible that even if Ford states they can change options at anytime, they cannot so long as a purchase order has been signed at the time the features were available or set forth as being available, without compensating the purchaser. (Who is on their high horse now? You really think Ford's legal team didn't think this through? How arrogant of you sir.)

I don't understand why everyone is rising in defense of Ford. If another individual on the street sold you something and misrepresented what you were getting, you would want restitution, and indeed would be deserving of restitution, after you found out you didn't get what you paid for. It is only fair that Ford makes it right, by either installing a working version of the feature or by compensating those who purchased an option of which they did not get full value. (Ah...finally you are intelligently (and civily I might add) arguing a point. I agree with some of this)

Why don't you stop personally attacking me, when I simply was disagreeing with a different SIDE...no one specifically. For someone who has so many creditials, you sure as heck do not argue your points well...and cannot do so without PERSONALLY attacking me.

Now before this gets out of hand anymore...

BACK OFF.

Would you stop with the "go sell your car bit" I didn't order the car because of the global open/close, I ordered the upgraded alarm because of it. Maybe you need to get mommy to help you read what people post on here cause you seem to be having trouble comprehending.

I never said I was unhappy with the car, or that I wanted to get rid of the car. I said I was upset that an option I paid for did not do what I wanted, which was why I ordered it in the first place. If you can't understand that, I don't know what to tell you.

I find it hard to believe that the people who would like to sue over a window feature, really need to get a hobby. I have more important things to worry about than pushing a button to open up a window. If it's that hot, start the car and turn the air on before you get in.
