reasonable royalty for their use of the patent." Weyer says. "It is my understanding that Ford charges around $750 for Interior Upgrade Package as a whole, and the MyColor feature accounts for probably half of that. At a 10% royalty, that would be approximately $4 for each Interior Upgrade Package sold. I'm surprised the Ford is making its customers, who have paid $25,000 to $30,000 for their new Mustangs, wait rather than pay a mere $4 for a patent license."

The hearing for the preliminary injunction motion has been set for February 28, 2005.
What's up with the math here?

First off, $750 for the IUP? Where'd that figure come from?

Then, he estimates MyColor is worth half of that, which is $375 by his figure...

And finally he wants 10% of the $375 for each car sold? or $37.50 per car?

Or is there a mistake somewhere, and the quote should have been 1% and not 10%?

Crazy...

I was saying that in the other thread that got closed. This may not be completely resolved yet. Leave it up to some judge that doesn't know a thing about the two designs to possibly place an injunction against Ford pending further investigation in February.

I still think to be on the safe side, everybody who have cars on order needs to try to get their cars built by Feb 28 in case this happens.

Hopefully this will work out and this guy will lose in court because from what I have read the designs are different enough for this not to be an issue.

Best news I've heard this week. Thanks Brad.
Does this mean that estimated deliveries of about 4 months may be less now.

Great news Brad! The horse's mouth didn't happen to say anything about the ICAP option, did they? There was a rumor that they cut back on this after a slow start, but the option has become more popular lately and there was rumor's that it might be slowing things up.
I cannot believe that is anything but a rumour, and most likely born of the IUP issue. Where one rumour grows several other seeds are always planted, and I see no reason for the ICAP to be considered anything but a success at this point, or that it was anything but popular to begin with.

ICAP would seem to be selling very well indeed if you can judge by the amount of people who frequent this site and have bought cars with it. And, when you cosider that to get ICAP you have to wnt to spend the money for the leather seats and the IUP I would have thought it would be less popular than it is. As a matter of fact Black with ICAP seems to be the combo to get right now.

Add on to this the fact that only 6 of the 10 exterior colors even offer ICAP and you have an option that is doing every well indeed considering everything else required to get it. I have little doubt that there are far more ICAP equipped GT's than V-6 cars, but I have a hard time believing Ford did not anticipate this. If I were a betting man, I would bet that ICAP demand has outstripped projections about as badly as IUP did, but I cannot imagine Ford is having the kind of troubles IUP caused.

That said, if Ford is having any trouble with ICAP nothing remotely official has been released about it. Strictly unfounded rumour and conjecture at this point.

I remember reading someone's post that the guy who filed the suit had a number of these filed for either this or that and that he is a patent attorney. If this is the case, it MAY very well be a situation where he hopes that if you throw enough crap at a wall.......some of it may stick. Sounds like he is "bargaining" already. One reason there are so many lawsuits of all kinds, is that companies, especially the smaller ones, due to cost reasons, pay these people off to just make them go away. Unfortunately, this just makes matters worse. When you are as big as Ford, you can't afford this approach. I have no idea on this guy's charge but I don't think there is going to be a conclusion anytime soon unless it is dropped

I wonder how long it will take Ford to catch up with all the IUP orders that had been put on hold because of the parts shortage?

Wow Thank-You now I can save even more money on Zantak so that will give me time to hunt down my grade 6 teacher as her hubby was a football player and I believe that he bought het a 1972 Mustang so called Olympic edition , I recall as she sent me to get some books from her car one day and when she gave me the key I said I have one that was so close that it worked. Freaked her out ! She lived at that time in Regina Saskatchewan, Canada and they had just relocted from the good ol US of A. So for the relief I will do my best to look her up for you Brad.

Well it took exactly one hour for someone to heat up the debate again after Brad's 3:25pm comment and clarification concerning IUP...But some people still don't get it and all the Negative Nellies and Chicken Littles still want to believe the worst...go ahead and believe what you want, but I have no doubt that IUP including My Color will be here for many years to come. Thanks for the info Brad!
