you dont buy a car for the freebie that comes with it. thats like returning a Ferrari because the freebie red sticker that came with itwas yellow and not red as was clearly written on the brochure, and THEN hurrying up and SUING Ferrari just days before receiving the replacement red sticker from them... nice going....

thinking for a minute, cant even believe your dealer would be willing to unwind the deal, your whole story of stirring up a class action suit + "spoke to the lead engineer at CARB" + first poster sounds like a fake, and I wish it is, because if you are for real, well thats pretty sad/

While I am very unhappy and disappointed with how things rolled out, the last thing I want to do is shoot myself and fellow enthusiasts in the foot over this by empowering lawyers and disheartening engineers who tried to bring us this great car in the first place. IMHO the hard birth the total 2012 Boss Experience had, only makes the total package all that more special. I also believe your dealer, and Ford Customer service can and will make things good for you on a case by case basis if you actually encourage rather than threaten this kind of initiative in the future. Just be realistic.

Class Action

Thanks for the warm welcome gentleman. It was simply a question. I wondered
if others had considered some legal action if Ford continues in their current
direction---Not delivering the goods. And yes, I did speak to the lead CARB
engineer. They are based in EL Monte California. And yes my dealer will
unwind the deal because he also believes that Ford and the dealership
promoted this car as a track car with a Red Key. Apparently the elusive
Red Key has been promised for months. We in California may be "nuts"
but we still expect truth in advertising.

Been 6 1/2 months since I placed the order for my Boss. They promised I'd have the car by June. By the time I get it, it'll be going directly into the garage for the winter. I remember when I ordered it in March it was still cold and spring wasn't even in the air yet. Go ahead, whine about an accessory, jackass.

...and thank you, Sir, for the wonderful first post. I'm sure you will find an attorney who would take your case, but not likely on a contingency basis, since this is a non-starter of an idea.

This is the newest article I have read about TracKey. It does not look like Santa will bring it to us for Christmas. The article was “California is why you can’t get the Boss Mustang TracKey” dated 22 September 2012.

Ford has promoted the TracKey for almost a year, but they may not ever be able to deliver it. I feel that Ford should have courteous to give the Boss owners and Ford dealerships periodic updates about TracKey.

If Ford is unwilling to make an official announcement to the Boss owners by the first of January 2012 all Boss owners should start a class action law suit against Ford for promoting TracKey and not being able to deliver!

Do any other owners feel the same?

I also have contacted both FMC and CARB by phone and email. I got the same bull from FCS via phone; TracKey will be released – soon. I have been waiting 4 weeks for someone from Ford to answer my email.

I talked to Lisa Chiladakis at the California Air Resources Board Public Information Offices. She told me the emissions rating are by engine size and TracKey should not be any different than an aftermarket tune kit i.e. SCT Power Flash Tuner.

Regardless of who’s at fault no one can refute the fact FMC has been unwilling and/or unable to be forth coming about the release of TracKey!

I agree with all the BOSS Mustang Online posts that FMC should give each Boss owner the TracKey download at no charge.

However, since TracKey was included by some dealership when the Boss owner’s purchased their Boss maybe FMC should give us the 2012 Boss 302-Owner's Limited Edition Print.

Below are the Emissions Ratings for the 2012 Boss without TracKey and 2012 Shelby GT 500.

It is hard to believe the Boss with TracKey would have a significant higher Emission Ratings than the Shelby GT500.
