no offense but this thread is totally worthless now. IUP WILL be back simply put. jsut a matter of when more of it becomes avalible. either stick it out and wait or change to ISAP or delete it totally. you can also do the aftermarket dash for the IUP if my color and message center arent important to you like i did. the aluminum dash is all i cared about.

Kera: Where did you get your info on dealership ETA between 1/23 - 1/30? From Ford? Or from the Dealer?

VOPC told me today that as of 1/12/05, my vehicle has been produced. But no further info.

What comes next?

I resurrected this thread because a notice has been posted on the news wire where the patent infringement case has been filed and there is a hearing scheduled on February 28th.

The guy wants $4 per unit royalty but if he wasn't inflated on what Ford is charging on the IUP he would only get $2.25 per unit.

Lets hope everything goes Ford's way or they build as many cars as they can before the 28th or whenever the ruling is detemined.

From everything we have seen, the waiting has nothing to do with paying Mr. Weyer and everything to do with parts shortages and allocations. He hasn't even been granted the injunction yet and the hearing isn't until February 28th. I think he is a little full of himself.

This would hopefully settle the debate of what the delays are all about. Ford isn't going to quit offering something to people with the fear that they have to pay out less than $5 per IUP installation. I'm sure Ford makes much more than $5 profit on each IUP installation. I bet that Ford ends up paying more to their lawyers defending this lawsuit than what they would even have to pay this guy.

I completely agree the IUP delays thus far have been due to supply issues. I just wanted to post this update that this guy has followed up on his threat of injuction proceedings, when the date is and what it appears his demands are.

I do not believe he has a strong case from what I read but if some judge sees things differently than most of us do, then we can expect a possible problem for anyone not built by Feb 28th or whenever the ruling is.

Since when does 10% of $375 equal $4? For some MIT guy that made a nice invention, he can't do math. This guy is a nut and Delphi's patent probaby is different enough from whatever his patent mentions. Ford needs to stomp this guy into the ground.

Sorry everybody I guess I was really asleep and didn't notice the decimal off on his calculations. it should be $40 and $22.50 per unit.

I guess I'm just as bad as old Franky boy.

And Weyer is a lawyer? You'd think he would check his math and validate his pricing sources before issuing a press release. The legal group where I work would never allow a document to go out that has not had all its facts double checked. Ford is going to walk all over this guy!

What does the retail price of the IUP have to do with the royalities that guy wants? He wants royalities specifically on the MyColor unit not the IUP install. He can't ask for royalities on the aluminum inserts and other aspects of the IUP.

So I'm guessing since he wants 10% of each unit installed and that comes to $4 the MyColor portion of IUP retail is $40.

Remember the lawsuit is about MyColor a component of IUP not the entire IUP install.

$40 seems low for the retail price of the MyColor component. If so, then it's good news for anyone who wants to aftermarket the instrument panel.

He's saying half of the $750 IUP (dealer invoice = $387, MSRP = $450) is the MyColor. So $750/2 = $375 (Reality $193 or $225).

Then 10% of $375 is $37.50...1% would equal $3.75, close to $4.00.

I have no idea the cost of the MyColor cluster, the leather, the message center, the aluminum inserts or the extra gauges, but 1/2 seems..."generous."

This guy just wants cash. His little snippet to me explemplifies how pompous he is. He did a patent, someone at Delphi saw it, changed it by 10% and refiled as a new patent, and now Weyer is crying.

Mike ~ Sorry I didn't see your post till today or I would have answered sooner. I called my General Manager & he said 1/23 & I called the Ford Customer Service Relations Center & they said 1/30. So I just assume it should be anytime in that week. I can't call VOPC because I don't have my dealers delaer number, so I am not sure what they say.

So I would call the dealership, the Ford Customer Center & VOPC & just put all that info together.

Anyway. Goodluck with it. It looks like it's close for you too.
