According to the complaint filed in the U.S. District Court for the Central District of California as Civil Action No. 04-08630 CBM (SHx), the "MyColor" TM option that is part of the interior upgrade package on the highly touted 2005 Ford Mustang infringes Mr. Weyer's patent for "Method and Apparatus for Providing User Selectable Multi-Color Instrument Panel Illumination." Mr. Weyer conceived of his invention while a graduate student at M.I.T. After the U.S. Patent Office granted the patent in 1999, Mr. Weyer sent a letter to Ford and other automobile manufacturers offering to license his invention. Ford did not respond.

Now, five years later, the new Ford Mustang features a user color-changeable instrument panel lighting system Ford calls "MyColor" that Mr. Weyer claims infringes his patent. Mr. Weyer is seeking damages and an injunction that would prevent Ford from selling or delivering any new Mustangs with the "MyColor" option. Mr. Weyer, filed the complaint on October 19, 2004. Prior to formally serving the complaint, Mr. Weyer contacted Ford, and offered to reach a cooperative resolution. Ford initially requested additional time to respond, which Mr. Weyer granted. After two months without a substantive response from Ford, according to court rules, Mr. Weyer was required to formally serve Ford with the complaint.

Mr. Weyer has informed Ford's in-house counsel that he is preparing a preliminary injunction motion that he intends to file in the near future. The preliminary injunction, if granted, would immediately bar Ford from offering for sale, selling, manufacturing or delivering any 2005 Mustangs with the infringing MyColor feature. That could prove to be a disappointment for Ford, which has launched a massive media push behing the 2005 Mustang, hoping that sales of the Mustang will drive its passenger car sales as a whole.
That's already been posted here many times. What we haven't seen is anything related to an injunction against Ford selling MyColor being granted.

Mustangs at this time are ONLY built and assembled in Flat Rock at AAI. It may be some subassemblys , engines, etc. built in Canada.
Engines are built in Romeo, Michigan, and the transmissions are built in somewhere in Mexico. [/b][/quote]
Off topic....but I gotta do something in the winter here The plate on my engine (Built 8/09/04) says it came from the Essex Engine plant in Windsor Ontario. It may be engines are sourced at both plants.

Yes Essex in Windsor was building 4.6 3v while Romeo got ramped up to production.
They also build the 5.4 3v

So no, the 4.6 3v for the mustang was not only built at romeo, but essex as well

After speaking with my dealer yesterday who happened to have the district Ford Rep in there yesterday (due to all the special on order hold) I have been advised that my car will also be built (probably 70% if not before ) in Feb.

IMO then Delphi is trying to ramp up production of the IUP package and Ford is purposely blocking IUP orders to make up the expected production figures on IUP and non-IUP units.

SO sit tight everyone.

Im pretty sure there is no injunction yet. My dealer received 2 Gt's yesterday with IUP and sold them already. It's just a supply issue. 99.9% sure of it.

I got more bad news , on the IUP you will get on the steering wheel and the auto 's but not on the 5speed man. or you can not get 125 dash lights, on the dash until April , what my dealer told me today sorry guys

You only get IUP on the steering wheel and on the auto. stick, not on the dash and the 125 lights on instrument - panel now, until , April 05 the IUP will be back on the Mustang

I think you're talking about the 18R package (aka IUP Lite). Dealers have been asked to switch 18G orders to 18R if possible.

I check my order status virtually daily; it's had the "compatibility error" for last several days. Today, it says as of 12/20 I'm clean and unscheduled!! Dare I hope to think that they're working through the IUP problems and updating orders accordingly??

alot of people have had the compatibility issue taken off their order, hope mine isnt too far behind, i cant stand tryin to negotiate for cars on the lot any more.

I went to the my dealer on Monday....took a test drive...awesome car...of course I couldn't take in more than 40km/hr with in the snow ..worst weather this year.


My dealer read me a couple of emails regarding IUP...and it is because of the lawsuit. Ford cannot install mycolor in any vehicles or sell anymore vehicle with mycolor in it.

According to the Ford VOPC, I have a build date of the week of 1/10/05, and I ordered IUP also.

Either the info about the lawsuit being the problem behind the IUP orders is inaccurate, or perhaps Ford was allowed to cut off the IUP production after orders already scheduled at the time the injunction was put in place are built.

Montrose--Now that's interesting. Who told you your car (i.e. with IUP) would be built in February? Dealer? Ford Customer Service? VOPC?

If true, then it's clearly a supply issue. This is the first indication we've seen as to the duration of the IUP holdup (i.e. only through January, production resumes in February).

As for "...no IUPs will be available in January...", as noted above, some of us with IUP orders have been given build dates of the weeks of January 3 and January 10. Although week of January 10 is the latest I've seen noted on TMS.

Please clarify. Thanks.
