I didn't quite have the nerve to ask him to prove it by starting the car, but he did say it sounded different with each key. Who knows. If I get 5 free minutes, I intend to call the dealership's service manager and ask.

Mayb Ford has or could ship the Track key software to the dealers. The dealers could then let the customers program their own cars. The dealers would not be liable because they did not program the cars for Track Key. Is that a way to get around a lawsuit such as this if the Track Key is part of the lawsuit ?

FWIW, I ran into a guy this weekend at a car show who just took delivery of his Boss 2 weeks ago. He's very involved in the Mustang clubs here in the northwest and told me not to believe everything we're hearing about the track key. He said that our local dealership, Riverside Ford, Sumner, WA activated his trackkey - it took about an hour to download the software. I don't know this person, but I told him I have a Boss on order and the Mustang community is small, so there's a 100% chance I will see him again. The dealership does have a good reputation and I'm not sure why he would lie to me since it would be easy to verify. Maybe the dealerships have the software but are being told not to sell it yet due to the issues?

Point is, no manufacturer stops manufacturing anything due to the threat of lawsuit, or nothing would ever get made. You literally cannot make anything innovative in the world anymore without factoring in the incoming lawsuits you will be the target of. That's just the cost of doing business these days. This is not hyperbole or supposition - it is plain, simple truth. Ford's not stupid - even if there is merit to the claim, perhaps especially if there is merit, Ford factors all of this in. It's incredibly hard to get injunctions of these sorts - even your windshield wiper guy didn't get one. He did not win all of his suits, far from it. And the money he made paled in comparison to the money made off of the invention from those who took the idea. Just another expense, if you will, no more, no less.

You are assuming the case, if there is one, will be lost, or just not settled. Put it this way - if this was a clear, highly legitimate claim, you would know - an injunction on the sale and manufacture of the disputed technologies would exist. And that would have been front-page news everywhere, because it would affect a huge chunk of Ford's current lineup. Remember the injunction against RIM a few years ago? It would look like that.

Not so quick there PACETTR, you can get a lot of knowledge at cruise nights. I took the Boss to one a week ago and I was told by a guy that if I track the Boss without changing out the whole entire brake system they will fade after one lap and I will heading off the track (I'm not kidding) gee, wish I would have know this before tracking the Boss several times

I want my Trackey and my Track attack, would be nice if Ford would at least let us know what is going on, since this was supposed to be part of the purchase, maybe it will take a class action lawsuit, you can not advertise and not deliver,I have won lawsuits against Kawasaki and Uniroyal over that, it is cut and dry, I am losing my patience with this

I would just like an official word from Ford, more on the track attack then the key, I do understand the carb process, I work in the automotive field, with cars out there in the 1000's now how long will it take to get the school for all that are wanting to do it, would like to be able to plan the time off with work, for my work the summer is the best time to do that, like I said would just like official word, I want to go play

They sell fireworks in Ohio, but you have to sign a waiver stating you won't set them off IN Ohio, because they're illegal here.
They should go ahead and send out the Track Key to all Boss owner's, with a disclaimer you must sign stating that you won't use it in CA until it's CARB-approved.

Let's go back to the 80's and just make it illegal for use in California. I'll setup shop at the CA state line and everyone can come see me for install When you get your car smogged, just don't bring the red key.
