Curious if this constitutes a lemon.... need help please

I own an '05 Mustang GT, I have written about this problem on this site before (prior to the weird metamorphosis of the site), but neither myself, nor Ford, nor my aftermarket dealer can figure out this problem on my car. I've owned my car since July of '05 and had no troubles whatsoever until after getting a Magnaflow (not magnapak) exhaust kit installed in February. After the installation I noticed that intermittently I would hear rattling, obviously unnatural noises coming from the driver side rear of the car - so I of course attributed it to the Magnaflow, brought it back to my installer, he observed it, had a new one ordered, and installed the new one - and the noise is still there. I brought it to my Ford dealer, they kept it for a week and had specialists work on it, replaced shocks/struts and other things, and absolutely could not figure it out and so they blamed it on the Magnaflow and told me to take it to a team of mustang exhaust specialists in my area in south Florida, I went yesterday, they heard the noise but are "99% positive" that it is not the exhaust as they could find no defect with it whatsoever and said the chances of 2 defective magnaflow exhausts is zero. They did say that my transmission sounded "mangled" but could absolutely not pinpoint the noise. I have an appointment to bring the car back to Ford on Tuesday... but does anyone think that this constitutes a lemon? Does anyone have any ideas on this? For reference... the noise happens roughly 1-3 times per driving from one place to another, and happens primarily in first gear when going slowly and then again in 4th and 5th when driving fast on the highway, and happens anywhere from just 3 or 4 seconds to 30 seconds at a time, and can be heard MUCH better with windows up versus down. Any help would be greatly appreciated.. thanks!

In CA a car is a lemon only if it is totally disabled and the dealer has attempted to fix the car three times unsuccessfully for the same problem.

An intermittent rattle doesn't qualify for "lemon" status. Sounds like you are in for a service nightmare my friend...

My first thought would be to put the stock mufflers back on and see if the rattle reappears over time, and if so THEN take it back to the dealer for further investigation. Be sure that all clamps are tight, exhaust pipes aligned correctly at the H pipe, etc...

I think that's good advice. Put the stock muffs back on and take it either back to the dealer or to another dealer.

Ok - #1 really have no idea regarding your problem but this came to my mind. There is a recent thread on someone having a muffler sound related to the exhaust rubbing/hitting the consolfe. The submitter said there was a TSB on it.

I had to get my tranny fixed due to a TSB on an intermittment grinding/growling sound. It usually started in third and would come and go. Sounds unlikely in your case but ...

definately not a lemon. that is a battle that, if you take it on, you will never win.

Ok a rattle starts AFTER you put something aftermarket on it, and it somehow has something to do with Ford? Sounds like you are already wasting Ford's resources trying to fix it through the dealer. If you had left it stock it probably wouldn't happen. First step is to put the stock exhaust back on the car and see if it rattles. And it is highly possible to get multiple deffective parts if it is aquired soon enough to get them from the same manufactured batch.
