I had the same thing happen to me about four years ago...... the lady backing out hit the side of my car, and was very apologetic. When the cops came, she stood there telling the officer that it was her fault 100%.

Two days later, I stopped at the police station to pick up a copy of the accident report for my insurance company. You would not believe- the officer wrote it up as a 50/50 fault accident! Half fault to the lady, the other half to me for being in the way! Seriously, I could NOT believe it. I spoke to the Chief of Police and he even refused to do anything about it, stating that the investigating officer was there and wrote the report and he didn't feel that he should modify the report. I ended up paying my insurance deductible ($500) to fix it.

About six weeks later, that same officer was suspended for other questionable acts that he was caught doing.

Anyway, I had an '04 Mach 1 so I can feel your pain- I'm sure you won't go thru the BS that I did though atleast.

HOPEFULLY this will be smooth. I spoke with both my and her insurance company again yesterday. Her insurance company has accepted responsibility placing 100% of the liability on the other driver (their insured). That being the case, I filed the claim completly through her insurance company - keeping mine out of the deal entirely. Mine closed the file (which can be reopened at any time with a phone call if needed). E-mailed off the pictures of the car, odo, VIN and damage to the other insurance company last night. Hope to hear back from them this morning - so I can make arrangements to get my car in for repairs

Its not really - its just over $1300. BAD thing is I have to be without my car for 7 to 9 days - driving a COMPACT car in its place I guess on the bright side - I get to save gas for a week or so

But what about that neck and back pain? did you make sure to let her insureance company know that your neck and back hurts?




I was really suprised, I has rearended by someone and i opted to go to the hospital just so they could make sure i was ok and when i talked to the other drivers insurenace they wanted to know how much the medical bills were and i told them, they were like 800 bucks and they are like, how about we give you $1800... i didn't know what to say, i was only looking to pay the medical bill only not looking to get anything out of it. I was like Okay... not to mention they paid me $1000 more then i owed on the car, and prob alot more then the car was worth. so I ended up making out with $2000 extra bucks for being hit. I was pretty amazed at the whole process since that was the 1 and only accident i'd ever been in.
