JBA Shorties vs FRPP Shorties

This might be a silly question to some but how are the JBA shorties 50-state smog legal and the FRPP shorties not?

I think it costs $$$ to get CARB certification. JBA is a CA company, so they spend the money to get certification. No reason the FRPP couldn't do the same.
