lol, they are shocked that FORD doesn't want to pay a $4.00 patent fee on each IUP. Come on guys, you are talking about a company that removed the intake cover, that would have cost them approx $6.00 per unit to make, so they could save more money.

Don't scare me like that. This clip is old but the hearing is today. I have been checking Google news every once in awhile to see if any updates are posted.

If they get the injunction today will production of the IUP stop today? Who knows the law?

Yeah, its a load of horse hockey. I doubt anything will ever come from this. If so, Michael Jackson should get this guys' judge and jury.

The hearing isn't today. Seems this fellow posted a message in another forum a few weeks back (it was him believe me) that he made an error in filing the claim and had to set a metting with ford first. After that he has to wait at least two weeks to file the claim again. The time for that metting has passed and I think if we don't see a news story of another filing, they may have reached a understanding. Let's hope this is put to bed.

Ford informed me on 2/21/05 that they are having problems fulfilling IUP orders. Stilling waiting on my V6 ordered on 11/15/04!

Dealer just told me my GT with IUP is scheduled to be built the 3rd week in March.

Understand that Ford is about 65,000 cars behind in building Mustangs. Orders have been that strong.....that's the reason you're waiting....not some goofy nut filing a frivolous lawsuit

Alright, I'm a lawyer but don't hold it against me...And as a disclaimer: this is not legal advice and you should see a lawyer with your individual situation rather than using this synopsis of the law. So here we go...

This bonehead made the mistake of stating his damages in his complaint i.e. $4 per car. Rule #1 of injunctions is that they will only be issued where irreprable harm will result if not issued. This would happen say, if someone had a particular piece of property and then didn't want to sell it to you. Or if something was going to be destroyed and you wanted to stop it. The idea of an injunction is kind of like a "time out" because the court can't act quick enough and there is really no way to fix the situation with money, or otherwise, if the situation happens. Here, this crackpot stated his damages in dollars exactly, therefore, an injunction WILL NOT be issued. His only recourse is to sue Ford and seek a judgment of $4 per car sold without his permission, assuming he has a valid claim. I don't know anything about the validity of his claim, but I do know that he's screwed on his injunction.

So... don't hold it against me because I'm a lawyer... I still love the new Mustangs!

Thanks for the clarification Ryan. It sounds very logical to me.

If this Frank guy is an attorney also wouldn't he realize this also and know the car would still be built, or is this something of a preliminary step is filed prior to his civil suit for monetary damages.

This is kind of what all lawyers do. They throw everything they can on the wall and see what sticks. Not the most efficient way to do things, but it is a logical progression. I wouldn't lose any sleep over an injunction being issued in this matter. Like I said, he named his damages so it kind of forecloses an injunction.
