Buying a previously tuned vehicle.

I know tuning will void the warranty. I have no problems with that when *I* decide to tune it. I want to buy another mustang from a dealership across the country, a 2013 5.0 (has the exact options I'm looking for). I want to ensure the vehicle is stock, tune wise, so I'll request the dealer to check and I'll get an oasis report done.

But.

Let's assume they say there is no tune on the vehicle, I get it in writing with a signature, pickup the car, and tomorrow the motor/transmission/etc goes out.

I take it in to my local dealership, they run diagnostic, low and behold it's been tuned at some point in time but it HAD been returned to stock and is still on the stock tune currently.

Am I screwed trying to sue the previous dealership for damages or will Ford corporate honor the signature from the other dealership assuming the paper has their letterhead on it? I just want to drive the car for 5-10k miles to ensure they're no issues with anything else on the car so I don't get any hassles or I can get warranty repairs and then start tuning afterward.

Ok, so first. A dealer level technician can not determine if there is a tune on the vehicle.

The only thing that the dealer can do is do a PMI on the PCM, and load what is the stock calibration on it. (This guarantees that its stock)

If you want to guarantee that the stock tune is on it, have the dealer do a PMI on the PCM before shipping it. Then you will have no worries.
