That would make sense if I was at all at fault....I wasn't. My car car didn't come from the factory with bondo, rattles or a carfax report that made it instantly worth thousands less, so where exactly did my rights go? the reason I am asking you guys and not USAA is because my insurance company isn't really involved. I reported it to them, but it is up to her insurance. I just want to know if anyone has experience with how far you can push no fault reimbursement. I am not looking for a cash grab or to milk anyone....I just want to know if someone has that prior experience to enlighten me :-)

Have it Repaired and Trade it in! My wife Crumpled the Rear quarter on My Black 05 and I lost interest in the Car After that. Traded it in on My Gt/Cs. Which is Now for Sale since I got a Gt-500 But Anyway as a Collectors Item I personally would trade it in after Repairs.

I would have never reported it to my insurance if I had no doubt all the fault was with the other person. You get a "brown mark" against your record for being in an accident. They tell you to tell them, but that's not always true. Just a chance to add up marks. Did you know your rates can go up if you have too many no-fault accidents? They see you as being in the wrong place too many times and are a potential risk. Only if her insurance doesn't pay does your insurance company step in.

You really gotta get over this "I have rights" concept and just get the car fixed. Think of this...you are in a foreign country and say "but I'm an American"...try and see how far that idea flies. Just take one step at a time.

well I'm not worried about my insurance rates because I've had 3 mustangs stolen and totaled because they were stripped and I was car jacked in a trans am and my insurance never went up for all those 4 losses....but I'm not quite sure about your american abroad comparison....I somehow owe it to this stupid girl and her insurance company to make it easy on them at my expense?

The system will work out....not exactly the way we always want it to (i.e. perfection) but it works. She'll get hers one way or another, and you'll get (close) to what is coming to you (repairs, medical, etc). If I recall correctly, based on a similar to your situation my wife had last year, the guy's insurance company said they were only responsible for making things as close as possible to 30 seconds prior to the accident for both the car and the injuries. Unless you were just pulling off the lot, the car was not considered "perfect" in the insurance world. Heck, I had to fight to get them to give me a rental car that was comparable to ours (Lincoln). They tried to give me a crappy Honda....I won with persistence. Good luck.

Mike, this is very bad advice.
USAA is not like whomever you are talking about. I talked to them about this very thing because I also had a rash of folks hitting my cars.

LOL, Ralph, okay....I agree in that what's good for one person is not for another (advice in this case). The "funny" part is I am talking about USAA. I've had them for......ever. I hear these wonderful stories about them, but have never had full satisfaction with them. Okay, get another company. "Funny" (again) is they (to me) are better (?) than all other companies. Maybe they don't like me personally....seems a lot of that going around
