Need help by hopefully a Ford employee

Long story short:

I put money down on a dealer stock car about 2 months ago- I did not special order it
I was told it would be in the middle to end of April- I was fine with a week delay going into early May

I never received any updates and found this info for myself-Car still in hold lot and hasnt been shipped.

Salesmen txt me yesterday and said a couple more days etc and it will be here "YEAH RIGHT".. he didnt realize i already knew the car is delayed. I cant wait another 14-21 days and the salesmen was well aware of this.

I cancelled my order yesterday with him(2 months with out a car)and found me 2011 and drove it home!!!!

He said I cannot get my deposit back because it was a"non refundable deposit" deal? which is all new to me???? I never saw anything like that and heck other than signing the credit card receipt the only other thing I signed was that I agreed to the price of the car.

I told this to my new dealer and they said NO way can they do that and they must give me my deposit back? Does this sound correct??? thanks

They can't legally keep your money unless they have your signature on something that says you agree to that. Even if you did sign something agreeing to that, if they don't want bad publicity they should give the money back.

If they keep it up you will probably have to hire a lawyer. You might try going to your states attorney generals office and reporting it to them, they mey be able to prosecute them.

Thanks for the input- heck I just want the money back and hiring an attorney most likely will be more then i put down 500.00. I feel they should understand my position and I never harassed them or anything during my wait. As far a signature I truly do not think I signed anything like that but I maybe wrong, it was back in March and all...

"Non refundable" desposits on cars are illegal in most states, even if you signed something.

Dealer stock not a good idea. I was in your situation and cancelled my order and got my deposit back.

Placed with RETAIL ORDER VERIFICATION (as opposed to retail allocation/dealer stock) and got my VIN/build date in two days.

He has no right to take your money. Does your buyer's order say it's non-refundable? Even if it does I don't think that's legal. You don't have the car, he has NO RIGHT TO YOUR MONEY!

A letter from a lawyer is all it would probably take to get them to return the money. Lawyer might charge you $200 to write it but if you have to go to court to get the money back then the lawyer would sue for the money plus his fee and court costs. You could also just go to small claims court and do it yourself.

Speak to his supervisor, then his, then the owner. If that gets you nowhere, make a sign (professional, not vulgar), and stand on the curb in front of their dealership in protest. All of that is free, just your time. Be persistent, and it will pay off.

WOW thanks everyone- Lots of good info. I will be headed to the dealer in my 2011 Ingot Silver Gt in the am.
The dealer I bought the car from said the same thing- I never received the goods therefore they should return the money. They said it happens on occasion and they always return the deposit.

If the deposit was paid via credit card contact the credit card company. Unless they have changed the laws, they have to get involved and should be able to reverse the charges.

It was paid by a Visa debit card- I spoke to my bank and if the dealer will not do whats right I will go thru them. I will let you guys know what happens today. thanks a lot for the suggestions.

The dealer doesn't have a leg to stand on. The car wasn't ordered for you. You just used the deposit to secure your place in line for an "INBOUND" car. Not a car ordered for you. They should give it back to you ASAP with no fuss. Just call and ask for the dealer principal. He is the person to talk to!!

UPDATE****** I went there and the salesmen went into the front office and came out and said no problem they will give you the money back***** Thanks everyone!!!!!!!!!! now time for an exhaust- this thing is to quiet
