Irresponsible driver

when his friend fell asleep while driving an Explorer
And these people actually have the gall to try to place the blame elsewhere instead of on the driver. Pathetic! I just burst out laughing at this family's stupidity. I feel bad for them, but it is not the vehicle's fault the driver fell asleep.

They also tried to say that it was the tires too, which would make a blowout Firestone's fault, but again that had nothing to do with the accident either.

Earth to the Halls!!! Trying to place blame on a uninvolved party will not bring back your child!!

Ford is appealing the ruling and most likely it will be overturned.

Hot McDonald's coffee anyone?

I won't get into the McD's coffee case, if you research it you'll discover it was a valid lawsuit and the woman involved did not look for an outlandish settlement, just medical expenses. Check out snopes.com.

But on this story, number of things make Ford's culpability less in my opinion - driver fell asleep and the passenger who was ejected had seat belt on, but had seat reclined, making the belt all but useless.

I'm not certain how a jury of Joe Publics could effectively evaluate the engineering characteristics of a vehicle, even with expert testimony, but if the vehicle was supposed to slide in an incident like this and not roll over, and Ford's design did not meet Federal specifications, then they could be liable.

Don't see how it is possible that they didn't meet federal standards, but who knows what evidence was presented.

Either way, the amount is ridiculous.

However, the "logic" behind it is while it might not bring back the victim in this case, it will prevent future victims by making enough of an impact to the "responsible" manufacturer. Only thing corporations understand is huge money settlements.

While the ruling might be overturned, a more likely outcome is the monetary damage amount will be significantly reduced.

Juries are played like fiddles, these ambulance chasing attorneys just tug at their heartstrings and play up the "big bad corporation doesn't care" aspects and voila!! Big settlement, upon appeal most of these though, thank God, are turned over!

Agreed, that is totally ludicrous. Where is the personal responsibility in this case? The driver FELL ASLEEP!! That is the ultimate cause of the accident not any real or perceived design flaws in the Explorer.

The next thing you know, someone will fall asleep at the wheel and blame the car for not keeping them awake (or the producer of the coffee they drank, or the manufacturer of the radio in the car for it not being loud enough, or the producer of the morning show they were listening to ON the radio for a lack of stimulating dialogue, and on and on).

Thanks in large part to lawyers, a large segment of our society ascribes to "it's not MY fault. I am NOT responsible for my own actions" belief. Truly a sad state. This is the same belief that allows someone to kill innocent people and blame it on the fact that their mother didn’t buy him or her Mickey Mouse sheets when they were a kid and failed to tuck them in at night. Please!!! I certainly hope that society hasn’t turned the majority of people into a bunch of limp-wristed wussies who can’t rise above their own stench to make something of themselves. In this case, I suppose blaming Ford helped clear the driver's conscience and "transfer" their guilt so they could sleep at night. Much better than dealing with the fact that their negligence cost someone else their life.

I apologize for the rant, this sort of behavior really gets under my skin, there are so many people out there looking for a handout or expect that society, the government or corporate America “owes†them something.

A rant is not a rant if it is logical and is from the heart.

Hey man, no reason to apologize for a rant. You pretty much summed up how I feel too. I was furious to read this, especially when you look at how ridiculous the claim looks when its presented. They say justice is blind, but man this jury must have been deaf too!!

florida does have one of the worst school systems in the country ..

i tried living there ..i lasted 3 months..the people are intolerably dumb
