This has nothing to do with the merits of the case, but a possible reason for Ford getting dragged into it: Does ownership transfer to Roush before the original owner makes the purchase? I know it doesn't with Saleen (and I think Shelby). If not, then it's a new, never titled car sold by the company listed on the MSO, which would be Ford.

When are these people who buy cars for investments going to realize that 'limited production' means: production is limited to how ever many cars can be sold.

Well, In all honesty Ford's liability in in this suit looks questionable but the plaintiff's case against Roush is darn good ! They will be able to produce hundreds of articles and statements by Roush Performance as too only 100 to be built! In fact there are numerous statements in print by Roush that there would only be 100 BlackJack's ever to be built. I am sure Roush / Fords legal response will be that all implied statement's where for that specific production year.

It's all about how a "reasonable person" would interpret Roush's 2007 BlackJack press release, which said, "ROUSH Performance is set to offer a limited edition run of 100 ROUSH Stage 3 BlackJack Mustangs."

Does that imply 100 2007 ROUSH Stage 3 BlackJack Mustangs, or 100 ROUSH Stage 3 BlackJack Mustangs ever?

Exactly - it's like KISS and their farewell tours - haven't there been about a half dozen by now?

Even if they have video of Jack Roush standing on a stack of Bibles swearing he's only going to build 100 BlackJack Mustangs, how do you prove damages? How do you prove that these cars will appreciate even $.01? Scarcity alone isn't enough to predict that - the tastes of future collectors will play a large part in dictating what is "collectible" or not, and that simply can't be predicted.

All cars are on the decline now days. Its they're loss. Life’s a gamble and you can't go on the word of a car manufacturer or dealer, That’s a bad bet. They put out a hook and someone took a bite, they just didn't count on being bit back.
Well we all got bit with the 05 to 08 models taking a loss, so its time to get over it. Time will decide if the price will increase again.

do these people seriously have nothing better to do with their life??? i think this is funny. i hope their case gets thrown out! *****ing because they overpayed for a 1 of 200 car instead of 1 of 100.

But that press release says the cars had already been pre-sold, so I doubt it will be a factor in the suit. If Roush was dumb enough to put something in writing prior to sale that says only 100 will be made with no mention of model year, then they have a case.
