I would verify the intake & cmcv's factory part numbers from each year to see if they are the same.
Because Dec 07 they rolled out redesigned heads to resolve the spark plug issue, and IIRC there is a slightly different bolt pattern for the cam covers for 08-10 4.6L vs 05-07.
Or you could go with deletes and ditch the cmcv (tune needed).

I'm not 100% sure, but I think they should bolt up to the earlier heads.
The only obvious difference is that the CMCV on the '09 intake is built into the intake runners, where on the earlier intakes, the CMCV and the intake runners are separate pieces

I figured since the FRPP intake fits 2005 and up, the 2009 would fit mine.
thanks for all the input, picked one up on ebay last night for 89.99 shipped
and it had the injecters with it. so I figured i swap those out too, since the 2009 intake was a dealer takeoff when they supercharged it at the dealer, 1 mile according to ebay ad

Well it did fit, the only problem was the bolts connecting the intake to the heads were too long due to the cmcv on the 2005 were thicker and had to be trimmed by 11/16 inch. Everything thing back to normal

thanks for the update, good to know... as the old 2V 4.6 plastic manifolds had such a tendency to crack, thinking a spare take-off might not be a bad thing to keep onhand for years down the road havent heard of any 3v issues, but they are just now kinda coming to that age where any durability issues might start popping up...
