You never know? I once met a woman who was allergic to hydrocarbons. Fuel, plastic, whatever if it produced a strong smell she would go bonkers.
Everybody loves soft touch plastics but the emollients used to make them can and do outgas and have been shown to have an effect on the health of the person driving such cars.
You can call the guy an idiot but what if he has a spotless driving record, displays reasonable intelligence and lives a healthy lifestyle and is in reasonably good shape for a 63 year old man?
IMO, health issues aside this seems like something concocted by their lawyers. Especially if the family of the deceased is looking for big compensation.
BF Goodrich several years ago had to pay out a multimillion dollar settlement to a woman who had a pair of tires installed in the incorrect position on the vehicle. Specifically the shop installed the new tires on the front of the vehicle which if all things are equal except the age and mileage difference can lead to unpredictable handling.
BFG's only culpability in the matter was stating in their handbook that its recommended when replacing less than a full set of tires on a vehicle that doesn't require the specific placement of tires (different size tires front to rear) that the new tires be placed on the rear.
The shop didn't and the lady lost control of the vehicle and it was shown that this was the leading contribution to the accident.
BFG bared the brunt of the lawsuit even though the tire shop made the mistake of installing the tires on the front and if I had to guess the woman was of average driving capability (and by average meaning had no real experience in controlling a vehicle once its out of control).
In any event enough reasonable doubt was introduced during the trial that the judge and jury sided with the woman (who ended up paralyzed) and awarded her several million dollars in compensation.
