Paris is right...normally in a private parking lot (shopping malls, etc.)...the police will not assign fault. It will be left up to the insurance companies to battle it out...no matter what, you're insurance will be going up (whether you were at fault or not). Right now just be concerned about getting her repaired to your satisfaction and the let the insurance folks figure out the $$$ settlements, etc.

I hope you got the plate number as well as the address off the card. And, if you didn't file a report and call police that minute, and this guy is an a-hole, its gonna be hard to prove he hit you, as its his word vs yours. I know he backed into you, but he can say, you rear ended him. Call that insurance company THIS SECOND and get things rolling!!! Good luck.
That's what I do. I keep an instant camera in my glove box. First shots I get is the face and the plate number... Too many people hit and run these days.

I went to two different bodyshop to do my estimate. One was a place the insurance requested me to bring to for inspection. The total cost there was $2,500 + more when they can tear down the bumper. The place that I took it to estimated it to be around $3000 + . when the joker ram my car he broke the highlight bracket on my saleen HIDS. I don't have the reciept anymore or the invoice . The body shop adjuster said he would need some form of reciept to prove the value of my headlight to the insurance company.

What can I do to get the proof of the headlight value? I tried calling saleen, but they are a total joke. EVerytime it would ring 6+ times and then go to mail box. They are probably going out of business.

If you guys look at the car in person, it doesn't look like $3000 worth of damage, maybe $400. I will post some pics when I can.

Usually several retail price quotes help:

A little update: I called his insurance company and ask what the hell was taking so long. The agent told me that they are trying to contact the retard that hit me. He hasn't call them back to verify the incident. So they can't repair my car until they are able to contact him. Is this correct or is the insurance company playing with me? He also said if he can't contact the dude that its best to go through my insurance company. I said hell no.

What can I do guys? Its kinda obvious that he is at fault if he doesn't call back. What can I do here to fix this? It is taking way too long. My car is cover with dust because I don't want to wash it until it is fixed.
