I believe damages have to exceed 75% of the vehicle's value for it to be totaled. The insurance company paid me for the damages minus the deductible.
The dealer and I had been discussing a trade for two weeks and had reached a tentative agreement two hours before the tree fell. That is why I was about to wash, polish, and detail the car for the trade the following day.
I called them back to cancel the deal but the dealer offered to accept the car as it was and came up with numbers which were reasonable.

That tree didn't fall on your car, more like ATE it. I can only imagine opening the garage door and seing that scene in the drive way.
