What would've happen if they removed The Mustang Source logo and added their own logo? How can you prove that you're one that took that pic? Its your word against his? Right?

And ebay is also getting notified from me. I still sell and buy from there too. If the picture isn't gone by morning.. the seller IS getting a phone call.
They listed it on the auction... 409-899-4000
Made a mention on a site that has a ton of Texas people on it.. curious to see how many have dealt with this dealership.
It IS a copyright violation... and it IS against eBays rule.

Actually they can't crop out the TMS logo on the rocker panel.

I'm no digital photo editing expert, but I think the only way to remove the TMS logo and not have it look strange would be to crop the photo and then add the new logo on what's left. In that case, Brad or Amy would provide Ebay with the uncropped photo with TMS logo. If the seller couldn't provide an uncropped photo with their logo, Ebay would rule in favor of TMS.

I did just that but will not post it.
(BTW: can we have an "end the quote madness" smiley?)
Emailing the seller and asking them to take it down worked
As did contacting eBay.
At 12:45am.. I get this email.. after I sent them one at 11pm.
Question about your item
Marketplace Safety Tip
If this email is an offer to directly sell you an item without bidding on and winning the item on eBay, please report it to us immediately and do not respond. An offer to sell an item directly to another eBay member through email violates eBay rules. It is also extremely unsafe to purchase an item through this email system regardless of the seller's claims or feedback, as you lose the benefit of eBay's purchase protection programs and risk losing your money.
Dear cretin75,
You asked:
"Hello... Please take down that picture of the 2005 Ford Mustang Convertible GT.. in the sonic blue color with the tan top. I took that original picture.. yes.. my name IS on the picture.. and that IS a test mule car... not one that is for sale. Please take it down as it violates copyright rules. If you don't take it down.. I'll ask ebay to. Thank you -Amy"
He wrote...
In the ad, if you take the time to read, it states that all pictures are for illustration purposes only. Once again, we apologize for using your material if it was protected. We will clear this up first thing when my computer department gets to work.
And I was sent a better link from eBay to report someone else doing this.
Problem solved B)

As of this post the pic is still up. Wonder what time the computer department gets in?
I'm not going to go back and forth about copyright rules.
Point is.. he has no business using that picture when Ford Motor Company has a lot of 2005 vert pics available to people that are not copywritten.
The auction is NOT still up. The public can not search for it.

Is that an issue? Got me, it's your pic. But you should know that the pic is still available.
no wonder the courts are crowded .... look at the backlog that was created here on this insignificant item...and we didn't even get into the man driving the test mules rights to photographic privacy which was violated when the picture was taken and then published on this site...or Fords right to not have test mules photographed...and the debate rages on...
