White Boss at Walnut Creek Ford (Ca)
White Boss at Walnut Creek Ford (Ca)
I checked out a PW Boss at a dealer today. It is the first one I have seen in person. I liked the Recaros, the burble from the exhaust, the front end and the instrument cluster. This car was ordered for someone who backed out once it arrived.
The color was "classic", but did not jump out at me. It did not say Boss to me in that color. This is a very good looking car in PW, but not what I would want in a Boss. The black roof did look better than I expected on this car. It looked like a glass roof from some angles.
They had an ADM of $15995. They had it in the back in the service bay. They did not want it on display. You have to ask about it if you want to see it. I arrived in my Saleen PJ. They wanted to appraise my PJ. I declined.
I am looking forward to seeing the Boss in other colors. If they make in in Grabber Blue, Orange or Green for 2013, that might entice me to sell the PJ, but for now I am waiting.

In the state of California, number one is that they have to have the same price everywhere. If it is one price in a newspaper ad, it has to be the same as on the lot, flyers, internet, etc... if they advertise it for a certain price and you come in and they say it is more, legally, if you have proof of the lower price, they have to sell it to you for that price. They will push back, but if you are persistent enough (and probably involve a lawyer), you can get the lower price. Having the two different prices are illegal, no matter how it happened.
I see this type 'mistake' all the time. They know better, but quite a few dealerships get away with it...

I think they can technically claim that cars.com is not the dealer's web site. On their own website, they state "call for pricing". At least they would be their defense. Does it hold up? If I wanted this particular car bad enough, I might push it and find out.
California Vehicle Code Section 11713.1 (this is just the definition of an ad, not the whole section):
advertisement" means an
advertisement in a newspaper, magazine, or direct mail publication
that is two or more columns in width or one column in width and more
than seven inches in length, or on a Web page of a dealer's Internet
Web site that displays the price of a vehicle offered for sale on the
Internet, as that term is defined in paragraph (6) of subdivision
(e) of Section 17538 of the Business and Professions Code.

And there are quite a few dealers that have a feed that directly links their inventory with Cars.com (as well with other online car selling sites). So, it could have taken the car when it was first entered into the system and was given a price, but since then, they changed their own site to 'Call for Pricing', but that won't reflect the other sites, because it was made on their own website, outside the feed...
Technically, each dealership is responsible for all pricing out in public on their vehicles, whether it was through them or a 3rd party site. They *could* argue that it wasn't a price on *their* site, but again, if you pushed hard enough, legally, they are responsible.
Oh, and Manning, leaver, Bruder and Berberich are the attorney's who have created the 'Dealer Management Guide', which is basically the legal bible for California Dealers. It is the place to find out if something is legal or not!
