unauthorized credit check!!!!

Angry unauthorized credit check!!!!

Hey guys I need yall help in figuring out what I can do from here. I am heated! I was the one deciding between the gt 10 or the v6 11 and the dealer that I was dealing with still had my paperwork from april when I was going to order a 2011 but wanted to wait for job#2. Ok so he ran my credit ofcourse then but when I went to see him last week he told me well this bank can give you this amount and that bacnk can give you this...... I asked him how does he know and asked if he ran my credit and he said that he was using my info from april and that he can't perform a credit check without my permission. Now I got an email from my credit report alert saying my credit has been check by two banks for auto loans.........I AM PISSED! What can I do now legal because I am about to flip! Thanks in advance

I am pretty sure when you filled out the paperwork, that you gave them the information they needed to get a credit check, that you implied authorization for them to run the credit check.

I don't think you have any legal recourse.
Never fill out any credit apps. until the car in on the way to the dealer.
(I know that is not much help this time.)

Under banking regulations (Equal Credit Opportunity Act in this case I believe), lenders (car loan, credit card, etc) can run your credit report whenever they feel they need to when it is associated with an offer of credit to you. Those credit card offers you get in the mail? They each had a credit report run beforehand (doesn't "count against" you tho), after which the lender's analysts then "set up" the offer in their database(s) in advance based on your report, and then they mailed you the offer, the terms of which they custom-tailored to you.

Yeah I never give my SS to them until I'm ready to switch from the 'shopping' stage to the 'buying' stage.

Yes I signed in april when I was about to buy a car but decided to wait. That is the only time I signed, so how could they do a check 3 months later with me just asking them how low can they sell me the gt2010?!?!?!?

You were more than 30 to 60 days out (they could not use the previously obtained information) and they were considering making an offer of credit to you (it's difficult to say for sure, some of this may depend on the original paperwork you signed - if you were asking for an updated price subject to the previous terms & conditions, then I can see why they'd re-run the report). I know, it sucks.

yo double edad, I also told the dealer that I was taking the cash back and finance through my own bank if they were going to cut the price of the GT10 really low. So they did not even have to run my credit because I was not going through with any of them since I was financing myself which he knew. Also he told me that he could not check my credit unless I authorized him to do so again.

OKAY so now I need more help fellahs! Ok so I got a letter in the mail a little while ago that was from a bank stating that the were declining my auto loan that I applied for with the dealership.......................ok only problem is that I never applied for a loan.........................so please tell me that is some type of identity theft or something?!?!?! What can I do legally now anyone know? This can't be legal!

Legality of their pulling your credit and/or applying for a loan (misunderstanding, possibly, I cannot talk for them) is totally up to whatever paperwork you signed without reading all the print. It is *possible* they did it illegally, but you really need a copy of whatever you signed to be sure.

The letter you get may be nothing more than an 'autocheck', that they were poking about trying to sign you up for a loan, but since you didn't go for it, or the loan was in fact not approved, they are required (here in Texas) to tell you that. It may be nothing, it may not. It sure is stressin' you out though.

You can also contact the store and tell them not only are you never going to do business with them, but because of all this extraneous activity on your credit, you are thinking mightily about suing them for damages. Maybe even emotionals. Or not. Depends on what you want to spend your money on. I'd just walk out on them and never darken their door again, and tell all who they are and what they do. Lighter pocketbooks in lost sales money typically do a better job. You might also call up the BBB and perhaps a investigative news crew... Their regional corporate managers... Perhaps the credit score people and say "I don't know who's doing all this, but I didn't authorize it, and it had better not be affecting my scores, or I'm coming after YOU."...

there's all kinds of interesting things you might do. Depends totally on how much time, money and effort you want to expend on the pound of flesh you desire.

That is not, by the way, a dig, but an attempt at rationality... you consider yourself wronged, and as such you are desiring a pound of flesh in retribution... Is it really worth it or not? This is something you must decide. I've done something like this before... and overall? Not sure it was worth it. Yes, I'm aware that the extra checks could do this or that to your score... but depending on credit for things, after the years of doing it myself? Not terribly a grand idea for life. Kinda wish I coulda learned that way earlier. I'm going with Dave Ramsey and getting out of the credit-using-business as soon as possible. Oh, I'll have one for emergencies, but overall, it's really just... not a good idea to me anymore. See below, btw, on more 'why' on that.

In any event, if you do go after that pound, you better have *everything* on your side... to which I again point to the paperwork. It's critical. If you don't have a legal leg to stand on... you'll look silly. Sorry. It's just the way it is. And it will take A LOT of time. You will be frustrated. It will be difficult. You may even not prevail. Prepare as best you can for either side of the win/lose situation, my friend, and good luck.

As to what you can do if you feel you're a victim of identity theft? Call any and all sources of the wrongful use of your identity, such as this bank, and tell them you are a victim, and ensure that they know you are being wronged, in your opinion.

Then, look at these:

Do everything they say in there (although I'd pick one credit score company to work with), and that's about it. Get all three on the alert by filing with one. It's free, and you can do it yourself, or pay someone to do it for you. This gives you a 90 day fraud alert on file. You will be called by whomever is being asked to make a loan or account, provided they check one of the three credit report companies (Transunion, Experian or Equifax) This requires you give them an easily callable during semi-normal business hours (say, 9-9 every day) so they can catch you and tell you "hey, did you want this $5000 JC Penny account and to have a TV and such charged to it, or...?"

Then file a police report. This does, unfortunately, require an actual attempt at fraud for it to be reportable, if you will. Assuming you have a good enough situation for a report, and they file it, you get a copy and send it in along with the formal request paperwork to the credit check company you've been working with. They will send back word that you now have a 7 year fraud alert, with the same 'call me first' rules in effect. It is renewable, if you desire, every 7 years. Filing with one of the companies, on either the 90 days or 7 years, should make all three the same. Be sure to get all three paperwork so you know they're all looking for this.

Be aware that if you are a victim of identity theft, any *current* credit sources you are using DO NOT check these credit reports. These are only checked if you (or whomever it is) attempts to open NEW credit. Whether it's a car, house, boat, credit card, loan, whatever. OLD accounts, even disused ones, that are still active, they do not check. So if someone has your information, they can just start using it. You will have to do the legwork on any outstanding and active accounts you may not remember... such as that Kohl's account that has a 0 balance, and you stopped using, but kept open just in case or forgot it was there...

At that point, it is up to you to do your due diligence. Look at all your statements, turn on any email alerts on the banking/credit cards/etc you can, and IMMEDIATELY REPORT any interesting items you see. Even going so far as to cancel all current cards and get new ones might be a good idea.

And after all that... it's kinda like a never ending game of how good you are at catching things. Because it will never go away. There will *always* be someone poking about.

I think its just an automated thing - prompted in part by recent laws that provide a free report when denied - and the Dealer is covering their butt by mailing the letter anyway.

I was approved by 2 CU's (I had provided my SS# to the salesman when I was ready) and I chose the best rate (3.24x84) and closed. Then about 2 weeks later the Dealer sent a letter like that - I assume for the CU I did not go with. (But I wasn't denied, I just went with the other lender.) But the letter appeared like a standard form letter and stated that I could get a free report by writing the credit bureau.

I wouldn't worry about it - but get the free report to ease your mind.

Hey at least they didn't go ahead and put through the loan which is what my dealership did!

Of course we didn't find out the TRUTH until we got both the dealer and the credit union on a conference call.

Dealer just went ahead and processed the loan WITHOUT our consent. So we basically had to get two loans. One from the dealer which was unauthorized and another from the CU to pay off the dealer so that we would pay them.

Of course the salesman didn't care, she got her bonus on commission for putting through the loan.

Gotta watch 'em like hawks and even then they'll try to screw you... or will.

As for everyone else thanks for the info! Maybe that is what it is and since I didn't get the car they had to send out something..none the less I am seeking legal advice and no matter what, I am going to the local new channels in my area to see if we can get some coverage on where to buy cars from...........and where not to ofcourse! The dealer had a nerve to try tosay they will work out a price with me and they gave me x-plan priceing...........I told them to shove it because I was already using x-plan so how are they doing me any favors?!?!?!? They will go out of business if I have anything to do with it! Thanks for everyones two scents...even yours modshack ya ignoramus!

Good luck there hotshot. Sounds like you'll need it.. Car dealing with a chip on your shoulder is never pretty.
