So... I'm in a predicament

I just went to check out this local GT/CS (NY) in performance white while waiting for my ordered car out of tucson, AZ. This car is fully loaded and is much better priced for the options than the ordered car I chose. I put a deposit down to get the car reserved, so I could call the dealer in AZ and cancel my order as it isn't scheduled to be built until 7/18 (ordered 6/3) and I am currently trying to sell my other car (VW R32) so I don't think I will have a car when I go back on 7/8 to drive. The dealer in Tucson is basically threatening to sue me for canceling the contract on the order, can they do this? I did put $1000 deposit down on the order, but is there any way to get out of the agreement? Any guidance is much appreciated, thanks guys.

I seriously doubt they'd actually sue you, since the legal costs would spiral out of control quickly, low ROI on that option. They'll definitely keep your deposit, though.

Whenever I have a problem, I always go straight to the top-maybe try talking to the dealer principle (owner)

You signed a "No Cancel" contract that stated the deposit wouldn't be refunded?

Sounds like BS to me and they are blowing smoke trying to keep you from backing out.

I would LAUGH if a dealer said they'd sue me. Especially with a high-demand car they'll sell at MSRP if you don't buy it.

You're going to give up the $1000 but if your other deal is better (including travel costs), walk away.

I have yet to see a deposit of this type that was really non-refundable.
