I believe they set the backlash - pinion depth.

This is true, carbon trap used only on the 05's.
I can't say if it's 100% safe to run without it without a tune, although the air/fuel will be somewhat lean, I don't think it'll be as bad as 'KJ' says.
All I can suggest is to run it on the dyno without the trap and see where the A/F is... or, get a tune that'll maximize the efficiency of the K&N CAI.

Hey Bill....where is the write up with pix where you trimmed your shaker?
I remember seeing that and loved it. I am doing the dreaded spark plug install and while I
have the shaker off I figured I would trim it up.

Pretty much mask off the area you want to trim, then hit it with a Dremel (I used the rotary file bit), go slow to medium speed, and clean the trimmed edges with a file. Installation of the door trim is optional. Mine ended up peeling off after a few years, so I just removed it.
