Dunno about the brand. But as long as they're coming out of an 8.8 you should be good. Don't quote me though lol

Gears that have already been broken in will whine if you reuse them unless the wear pattern is exactly the same. My gears were silent before I replaced a blown limited slip diff, and now they whine above 45mph.

Yea the ring and pinion are pretty cheap. I think you can get the gears and the kit for like $250

Yeah new gears are the way to go, and installed by someone who knows their way around this differential. You won't save any money if you have have the work done twice.

The ford 8.8 in our cars is pain in the butt. I had the following done on mine by a mechanic who had done several truck differentials in the past.

*New FRPP 4.10 gears installed (Set A) at .008 backlash
No whine

Then I broke my track lok spider gears at the drag strip

*Put in new Limted Slip Diff (Truetrac) + New FRPP 4.10 gears (Set B) at .012 backlash (he tried this twice, both times it made noise - first from a scored bearing the second time from the gears )
Howled on deceleration all the time

After putting all that time into the diff, I needed my car back and my mechanic needed to catch up on other jobs so I took it home for a while.

*He then put in the old gears "Set A" and they were much better, still make noise above 45mph but much less. He did this free of charge as a fix for the previous work.

There's a possibility I twisted something in the pumpkin, but it's been a lot of trouble and it's at an acceptable state for now.

My car has 38000 miles should I only get the gears or would it need the kit

You will need the kit for the installer. I had
mine done at about 2,000 miles and the installer, a Ford master tech, insisted on it.

And +1 on not reusing the old ones. It can be done but they'd have to be precisely marked coming out of the old car and even them not worth the chance. Also it is the general opinion of most threads I've read here to get the FRPP Ford gears and stay away from others if you can. Some claim the Motive brand are more likely to whine and others claim theirs are fine. But why take that chance.

Edit: and don't forget the little bottle of friction modifier for the limited slip.
