Let me ask a few questions and I will try to help:
Is it the original backup tune your trying to get from the tool?
Did you install the driver for the USB / serial cable?
Which COM port is your USB cable using - mine uses COM4.
What version of DS Downloader are you using?
What is the BAUD rate set at - both Predator and PC?

Are you trying to upload the tune to your pc??? I'd try contacting Diablosport directly or going to their web site to see if they don't have any instructions posted there. Sorry I couldn't be of more help.

i set the baud rate to 11520 on both the pc and the predator... whenever i use anything other than COM3 nothing happens.... wheni use COM3, a box pops up that looks like a download box but it disappears immediately and on the bottom od DSDownloader is says "backup failed"

Eric,
Have you downloaded the original factory tune into the Predator yet? You have to do that first, and then the Predator will try to upload it onto your PC. Until you do that, you won't be able to do much else.

Sounds like one possibility is that you MIGHT have a port conflict on your PC (this is interfering with your PC's ability to communicate across COM3). If you do (and I'm not saying that you do just that you might) it'll take a lot more than just a few questions to resolve your PC problem.

Are you using the Diablo to transfer the file or trying to use the PC software to? You have to enter the Options->Custom Tune menu within the Diablo and select "export tune" and then just open the Downloader program and then you should be good to go.
