diminish value estimate

No i didn't. since the other guy had no insurance, i had to use mines, liberty mutual.
they tried to get me to accept $800. my volcabulary went off the chart. went to my dealers used car guys, to see what i would loose on trade in. he put the car in the system and gave me a print out. would loose $10k right now. I thought that was a little high but i'm just a laymen here. I have gotten estimates $3500, $6000k to $10k.
I have file a civil action against libert mutual insurance for $5k plus court cost?

I'd suggest that you negotiate with your insurance company and find a reasonable number.

that's absolutely wrong. In civil court the judge is not swayed by attorneys. he knows what's fair and i bet you the settlement is more than what the insurance co. is offering.
once they receive the summons, their stance will change. they will offer more, rather than going to court with a high dollar lawyer?
