I do agree, VBR (variable bitrate) is the way to go these days. It gets rid of any signal that is either too high or too low for the human ear to hear and that will also help reduce the file size.
Non VBR (CBR) mp3's also cut frequencys out of hearing range. Thats always been part of the mp3 standard.
