Its called a carpool lane. You can see the sign in the center divider (There is no shoulder). The driver of the mustang should have seen the van was stopped there though. On the other hand, the driver of the van should have had it emergency lights on. But I will agree most drivers in So Cal are retards, 99% of which live in Orange County.

There were at least two people in the car, which in most places qualifies you for use of the HOV lane. Don't know about the particulars on this stretch of road, but outside of rush hour the lane is usually not restricted.
