I had court yesterday for the accident. It was supposed to be a Jury trial but they ended up plea-bargoning.
How do you "plea-bargon" to a driving charge?

I thought plea bargoning is for people who have information that could lead to another more serious arrest.

A plea bargain is an agreement in a criminal case in which a prosecutor and a defendant arrange to settle the case against the defendant. The defendant agrees to plead guilty or no contest (and often allocute) in exchange for some concession from the prosecutor. This concession can include reducing the original charge or charges, dismissing some of the charges against the defendant or limiting the punishment a court can impose on the defendant.

thus he plea bargoned so he could get "innatentive driving" instead of reckless driving.

I'm sorry to hear that it's been so long for you to get to this point, but I am certainly glad to see that there is justice.

I forwarded your original topic to Hau since he was the Chief Engineer, and he told me that he and everyone on the S197 Safety and Engineering Teams were fully aware of your accident and had seen the post.
Will they be doing more testing on this? 50 MPH isn't very much to cause the backseat to just collapse. Seems like it could be very dangerous. I know it was a F350 and it would have more momentum...but still, that whole top rear end was just destroyed.

well, given that the car was sucker-punched by an illegally modified vehicle operated by someone with total disrespect for the lives of others, I would say the outcome says alot to the structure of the Mustang!

I would have hoped they would have been a bit harsher on the driver!
good luck Emilee

Emilee,

So glad to hear that you survived the crash and are eventually receiving justice. I hope that this will cause the 350 driver to pay attention. He must really be glad that you survived. He could have been facing much stiffer penalties. It looked so bad and so close.

Enjoy your ‘stang. I should get mine Monday or Tuesday. Let's all drive safe.

The F350 that hit her was raised so high that its bumper went over her bumper and barely hit the top of the trunk lid. As trunk's are made to be hollow, you know so stuff can be put in there, they don't offer much resistance to 2 tons of 50mph force. Most of the force of the F350 hitting her car was absorbed by the pillars supporting the roof and the glass in the rear window. Considering how high the F350 was and how the well the front 2 seats of the passenger comparment are, I'd say the car actually did the best any similar car could do. There simply is no car that any back seat passenger's would have survived that crash. The whole key was the height of that F350.

The only thing that can be done to prevent future accidents like that one, is to either make it illegal to raise a vehicle to a height where its bumper can fail to contact another car's bumper, or to make it mandatory that a raised vehicle have a bumper that is at a normal bumper height.

Notice how high the F350 is on the mustang. The F350 hit the highest part of the trunk, then either climbed on top of the mustang and/or forced the mustang down. At that point of impact a trunk doesn't offer any resistance and was simply pushed into the car. If I remember right, Emilee was stopped at an intersection and pushed through it. Its actually amazing that the F350 was stopped from climbing on TOP of the mustang and the force didn't crush the car worse.
