Decide if you are going to deal with this yourself or utilize the services of an attorney! Then stick with that choice. First of all you need to know if you have an attorney or not??? If you do STOP Futzing it up and let him do his job. If you do not have an attorney, get one.
As far as dealing with this dealer or anyone else for that matter, simply go in to the dealership and walk into the General Managers office and demand he speak with you about it. If you do not have your ducks in a row, a complete list of deliverables you insist on them providing, don't even contact them.
I once years ago bought a used car from a new/used car dealer that had quite a few problems. I went in and told the service manager and the sales manager that if they did not make the required repairs to the car, I would make big 4x8 signs for my pickup truck stating that their dealership rips off their customers and refuses to make it right, yada, yada, yada, and I would spend all day long everyday in front of their dealership protesting their dealership. They decided to fix all of the problems, I never even had to make the signs.
Continuing to "email" them, with no reply is really weak. It is like telling your dog to sit 32 times in a row, and still accepting him not sitting...

Regarding the dealership and emailing them, I really have no other way of contacting them. They are closed while restructuring their busniess, and they are located over 2 hours away from me even if I wanted to pay them a visit (which would do no good because they are not there). They choose not to reply, and I simply cant' do anything about that. Also, I am speaking directly to the owners of the company, and have voiced what needed to be done with this situation. I have all my ducks in a row, and made my demands very clear to the owners of the company. I'm not at this point willing to demand anything from them and use any, "or else I'll do this" tactics, because I'd like to avoid that at the moment. I don't even think they know this thread is going... I have been thinking about sending a link to it though...

Hopefully you get this handled soon. I have had a few problems in the past and each time an individual tells me there is nothing they can do (when I truly know they can), I just say, okay and then tell them that I plan on slamming their business on multiple forums on the internet. I'm not saying its the coolest of things to do, but it's worked each time for me. It went from NO, to were doing all we can, to okay we will take care of it.

First, regarding the attorney, his advisor told me he is currently looking over the case and I would recieve a call within the next few days on whether or not he would take it, and what we could do. She assured me he would contact me within the next few days, and we would go from there. He is not "my" attorney, just one of the ones I have looking over the facts. In no way am I, or will I be "futzing" it up, or keeping any of them from looking over the case. And I am working very hard on getting an attorney, just gotta find one to accept the case ya know...

Unfortunately, if the owners went BK chances are he will win a judgement that isn't worth the paper it is printed on. The odds of this increase the longer the OP delays in getting legal action started. Delay = defeat! That's why like buffguy says - get the legal action going NOW, and see about getting a judgement against any of their remaining assets BEFORE they have time to ditch them and then play the poorhouse routine.
Because it appears he doesn't really want to resolve the situation. I agree with the poster that said emailing is like telling your dog to "sit". It does no good. Getting an attorney might be difficult because many attorneys won't want to waste their time on "nickel and dime" cases like this one (no offense intended, just making reference to the relatively low dollar amount they would get as a percentage of any body repair judgement)

How come you haven't taken my advice on taking this dealership to a small claims court. It would only cost you about $20 or less to file papers. You don't need an expensive lawyer. You can be your own lawyer. The court will send the owner a summons letter and he would have to appear in small claims court with you on a given date. With you and him stating your side of the story and the judge will decide who gets paid. All you have to lose is some of your time and maybe $20 bucks. This will also **** the owner off, because he would have to appear in court. Get your information and facts ready and you will likely have a good case.
After getting a quick reply the situation has now risen to the point I did not want it to reach. I have never made a threat towards them, and never wanted to. I was threatened with legal action, and spoken to in a manor that from one adult to another is strictly unnecessary . I'm giving up. I'm done. Never have I once stretched any truth in this thread, or have had anything bad to say about these guys at all. I have not been malicious towards these guys in any way, and have actually spoke good about them in many parts of this thread. This was a venting post, and was only intended to be.

If the threat was made via email, SAVE IT, and show the authorities IMMEDIATELY!!!
No physical threats. Just a threat of legal persuasion.
Google "Florida small claims court" and read up to see if you qualify. Their threats of legal action are just that, threats. If they are re-structuring then where are they going to get the finances to pay for an attorney? Also find out if the filing is in the county of the plaintiff or the defendant. Each county will have a help line with the clerk of court. One issue I see is that the court is not responsible for payment if you should win. Which means you may have to attach a lien to their real property. Not a sound deal if they go bankrupt.

You were sold a car with a "bad" Carfax by this dealer that was NOT disclosed. The dealer then "attempted" to shoddily fix it, returning it to you with a paint job THEY would probably spit on if it were one of their personal vehicles.
AND THEY ARE THREATENING YOU WITH LEGAL ACTION???
BTW, if they were educated in law, they'd already know that libel suits are VERY hard to prove against private citizens as the attorney must prove malicious intent, which is obviously not the case in this situation.
Sounds like they are proving to be the caliber of people some people on this thread suspected...disappointing, but sadly, NOT surprising.

This is exactly why I suggested he stop emailing them, even letting an attorney handle it and most of all NOT FUTZING IT UP.
