Ya it would make more sense if the picture of the car was what they were actually getting. Sure you say he has the right to sell it but every court will tell you that misrepresentation is illegal.

Ebay isn't a real contract. They say it's "binding", but it isn't. The worst thing that will happen is that the bidder will end up with negative feedback. But look at the high bidder on this auction. His feedback is only two. This guy doesn't care about getting a negative feedback.

Most of Ebay is a binding contract except for stuff like cars/houses etc.

Maybe the 10000 was the guy's downpayment and now he found out he can't afford the car and the dealer won't give him back his money? We have heard of that happening, right? Or of course, he could just be an idiot. Highly likely.

I have no tolerance for unbridled stupidity. If you pay SOMEONE(other than the dealership) a cent to get their spot and possibly an early car you deserve to have twelve like it driving down your street everyday.

Now if someone where to honestly get scammed out of some money, thats not good, but still lets be real.
