Put in my 2nd order today

My 1st order is still C/U, Priority 18. Went and ordered again at another delaer, Priority 10,order#W100, which at this point I think that it means nothing. This dealer guarantees me the car in 60 days! So I have 2 orders in and the 1st will win. Now this second dealer says you cannot get back your deposit. I said otherwise. With the new dealer I signed a contract that does say all deposits are non-refundable. The 1st dealer I did not sign a thing. What do you guys think?

Hey Scott, about the deposit issue. I work in sales In PA, and on the Buyers Order, the thing the customer signes whenever he/she purchases a car, there are 3 spots to sign, the 1st is for the warranty, the next line to sign has a blank area to write in an amount that would be forefeitted, and the last is to sign for the car. In this state, if you sign your name on the 2nd line, and know about the amount that may be non-refunded, it means you would lose the deposit, as it is a signed contract.
Now, I rarely ever have someone sign that area (99.9% of the time its never used), unless they are ordering something so off the wall (Yellow 4X2 F350, or something of that sorts), that when it comes in, and its ordered 100% correct, and they DO NOT take it, and they don't have a REAL legit reason for not taking it, they would lose the deposit. Now on a Mustang, that dealer is just being stupid IMO, because, if your car comes in, and you don't take it, BELIEVE ME, they won't have any difficulty in selling it. It would be in their best interest to give you back the money. They would get ALOT of flack for not giving you a refund. Hope this answers your question.

If you signed something stating that whatever amount is non-refundable, then by all means they do not have to refund anything. If you didn't sign anything at the first dealership, then all of it should be refundable.
