Lady Backed Her Car Into My Parked Mustang.

I went to in and out at 10:00 tonight I backed into my parking spot so my front bumper was facing the road. I went in for only 2 minutes no longer, I walked out and as I am leaving this hispanic guy starts talking to me, and he says this lady hit my car and left, but she went threw the drive threw of in and out, so I go to in and out and tell the workers hey some lady in your drive backed into your car, so the lady pulled out of the drive threw and I stopped her and said you hit my car, she said oh no I just barely bumped it and she looked at my bumper when she hit it, and she told me to my f'n face oh that mark was already there on my bumper, because her car was maroon and mine was white and the marks were black. So we go look at her bumper and her bumper is full of my white paint, that his flaking of as she rubs it!
So I got all of her info and she gets mine, I go home and she goes back to Wall mart were she works(serious).
This is what pisses me off, I tell my Dad I am calling AAA tomorrow and he says no your not, I dont want you calling AAA because you were in accident six months ago(totaled my Taurus my fault), and they look at that. I tell him its not going to change my insurance at all, the lady hit my parked car!

Should I go against my Dad and call the insurance company? All my brothers think I should along with my Mom.

Cliffs
-Lady Hits my parked car
-Messes up bumper paint and dents bumper
-pops lower grille and upper grille out of place(Now in place again)
-Dad wont let me call insurance company

Are you living at home?
Are you on HIS Insurance Policy?
Are you paying for Your Insurance?

If you are at HIS home and on his policy, do what HE says. If you are living alone and pay for your own Insurance, do what YOU want. If you are at home and on his Insurance, and you call anyway, be prepaired to pay ANY difference between the premiums that you pay now to what they become. And let me tell you, Insurance companies don't give a rats rookie who's fault it is. It goes down as a Incident, heck, they even raise rates if you call them too many times.

If it's your dad's policy then he calls the shots, end of story. Since you got the lady's info you should proceed against her insurance company.

I don't know why your dad is so against it. Your car was PARKED and she almost did a HIT & RUN!!! But like the others said. If its your own policy, call them ASAP. If its your parent's policy, do what he says. Sucks, but its life. Its why my parents got me my 1st car (a 1985 Nissan 200 SX POS) and they got it for $500 but I had to get MY OWN policy and pay for it!! I'm glad they did that, as it made me more responsible.

call the lady up and tell her she is going to pay for the bill without insurance. get the car fixed, send her the bill! don't get insurance companies involved or it will go against you in the long run.

Yeah, that'll get paid fast...

Claim it against her insurance, and while you're at it, file a police report so it's official, but do NOT go after her yourself, and do not file it against your insurance.

The police report is so that insurance has more legal reason to deal with it. He said, she said (appropos in this case) is not as easily convinced... especially if the she in this case was trying to deny it all the way.

I'd say get a body shop quote (it'll probably be $500+ for them to get the bumper and then paint it). Then tell the lady that you'll do it without insurance for way cheaper and get a newtakeoff part pre-painted. On performance white it'll match perfectly. You could even upgrade to the GT bumper including the upper grill with lights. It's a super easy do it yourself job that will take you an hour (probably less). I've done it.

edit: I'm assuming that the bumper is deformed here.. can't quite tell from pics. If it's deformed, they really can't fix it (plastic) so body shop would have to get a new bumper).

Definitely agree with the the gist of your point -- except that insurance companies do care who's fault it is. If it's the other driver they file a claim against the other driver's insurance policy, it's called subrogation. Will they do that for something as smalltime as this claim?

And if you're ever in a real accident (either side's fault), do yourself a favor and report the accident. If you don't and you wind up with medical problems or damage you're liable for, it's written in your insurance contract that the insurance company can deny the claim because you misled them.

And if you're worried about your auto company denying a claim over something small... for goodness sake, do some research and find a good insurance company!!

Monkeycat -- the advice to go where the money goes is good -- if you pay the insurance and the car payments then you have a right to do with your property as you decide. I'm going out on a limb assuming you're under 25, but if you're under 18 and the car is in your dad's name... heck, it's not even your property. So you may want to buckle down a little. It looks like really small time damage, easily fixed, don't blow it out of proportion -- the bumper isn't in your trunk or anything.

So I wont claim ill just get one from Newtakeoff.com

Whats kind off ironic though is on Monday I said I wanted a GT front bumper.
On newtakeoff though the shipping is $132 for the bumper.

I doubt the other party wants it to go through insurance either from the way it sounds.

Tell her it'll cost you $350 to fix it and see what she says.

If no, go through insurance.
