There were salesman all over the car calling customers who've been waiting for a GT to show up while I was there. I'm sure it was gone that same evening. Every one of the dealers GTs that come in are pre-sold. I even got into an arguement / discussion with one of them trying to tell me to take it, but I don't care for manual transmissions in my daily 40+ mile commute in heavy stop and go traffic. I've owned 2 manual cars, the first one was a GT Mustang. I got tired of rowing the boat.

I'm looking into legal action against them.

A promissory estoppel is basically a promise by words that leads to detriment based on your reliance. While that all sounds fine and dandy keep in mind your earnest contract will supercede any stretch of a promissory estoppel suit. I too wish FORD would step up and end their dealerships failures in customer service.

Here in Ohio you can file complaints with the BBB and AG online. By law the AG has a certain time frame in which to respond to your complaint. My turn around time was less than 30 days to full resolution from the day I filed. The BBB has a tremendous amount of power as well. Way more than I was aware of. Do this today...no matter what you decide to do about the car. It only takes a couple of hours and then they handle the rest and it's FREE!!!!!
Even if nothing comes out of it you at least wasted their time and let them know you weren't a pushover! Maybe it'll stop the games.

I'm sorry to hear about your troubles with the dealer. I am in a similar situation. I ordered Dec 22 and my car arrived Feb 17, but my dealer changed my order from having the IUP and ICAP to without either one. I personally feel he did that because he knew he could get the car in quicker and easily sell it if I didn't want it. That way he gets a sale earlier and more money in his pocket . For me, the interior is just as important as the exterior, and I wanted what I ordered (or else I would have bought off a lot), so I had to put in another order and I'm on the wait again .

I really hope it works out for you.

Louis, that stinks but I have to ask, did you not get a copy of the DORA so you would know exactly what was being ordered?

The sheet I have is a Vehicle Order Confrrmation sheet listing all the options and prices. The only difference is the order number is set to 1111 and the priority is 99. I was standing by the GM when he entered the information in the computer, and then printed it out for me to verify everything was correct. I asked about the priority and order number at the time, and he said a office person would formally submit this to the system on Monday and it would receive a valid order number then and the priority would be changed from 99.

This reminds me so much of my first dealer and the games they played!
One other thought I don't beleive we (the consumer) are legally entitled to the DORA, since it has info. that dealer/manufacturer may not want to share with the public at large, so in a legal dispute I beleive the VOC would hold up. Also, the majority of consumers have no idea about this stuff.... DORA, VOC, etc....so I don't think that is an issue here.

I'm checking into taking them to TN small claims court. I will make my decision on whether or not to pursue it after this Friday's orders are pulled. If the high priority car isn't pulled and scheduled for an early April build, I will meet with the GM at the dealership, and give them one last chance to reduce my losses by selling me the car at "A", plan. This only makes up about $1000 of my estimated $2500-3000 loss since Nov. If they refuse, I will have my deposit refunded, cancel the order, and contact the General Sessions office for the proper paperwork to file. I honestly think no judge would rule in their favor. I'm currently trying to find an attorney to discuss the matter with.

Hi Louis,

First off I want to say that am really sorry for what has happened and for what your going through. I cant imagine if such thing would have happened to me.

However, here is my opinion and I could very well be wrong. By doing what you are I dont think you will accomplish much. I think the judge would say that you are given an option to order another vehicle and for you to do so if thats what you wish. I think in the long run all you will do is waiste your time and maybe even hurt your health over the aggrevation.

This is what you should do. Be firm and and tell them that you feel that they should do the right thing. You will not get anywhere with anger or an attitude. Try to talk them into anything you can such as extended warranty to help the resale of your 05 (when/if you sale it) to balance out the money you have lost, try to get as many options as you can for no cost, such as IUP and interior upgrade, side air bags etc. If your not getting anywhere I would recommend that you request a meeting with the GM and a rep. Most dealers hate getting a rep involved. The rep normaly does anything he can to keep costumers happy and the reputation of Ford in good standings.

Again, this is just my opinion and advice. I wish you the best of luck.

Thanks for the advice David.

I may end up using the BBB, since the dealer is a member, but before I go that route or pursue the legal one, I'm going to talk with the GM after I find out the status of the car. I do plan on being as nice and firm as I can possibly be, and hopefully he'll offer me more than just an attempt at an expedited order. I realize that no matter what I do, I'm still not going to have a new car any quicker, unless I purchase another make, which I will most likely look into by this weekend. I'm ultimately the looser in this situation no matter what transpires.

The regionall rep is already involved. The sales manager contacted him on Monday while I was at the dealer. He is the one who is supposed to have an order changed to a 2 from the normal 10 priority. I would think that would be all he could do in this situation. Without pointing fingers, the previous GM is likely the one who changed the transmission option on the car after the VOC was printed. He's now at another dealership owned by the same company, so the current sales manager wasn't privy to the situation. I agree that management above their level needs to be made aware of the situation.

I guess the second biggest problem is that if the new car doesn't get built soon, it won't arrive unitl mid to late May with the current shipping delays. The manual trans car spent over a month in transit. I would be better off waiting another couple of months until the 06's come out. :bang:
